Summit County Colorado has complex short-term rental (STR) regulations that vary by location. Understanding these rules is critical if you own property or plan to invest in Summit County vacation rentals.

What is a Short-Term Rental

In Summit County, a short-term rental is any property rented for less than 30 consecutive days. All STRs require a valid local license.

Rentals of 30 consecutive days or longer are considered long-term rentals and don't require STR licenses. Long-term rentals are encouraged as they provide housing for local workers.

Two Overlay Zones in Unincorporated Summit County

Unincorporated Summit County uses a zoned overlay system with two main zones: Resort Overlay Zone and Neighborhood Overlay Zone.

Resort Overlay Zone:Includes Keystone, Copper Mountain, Tiger Run, SkiWatch condominiums, and the 4 O'Clock subdivision. Properties in this zone have unlimited STR licenses available. No caps, no waitlists.

This is critical: Copper Mountain sits in the Resort Overlay Zone, which means STR licenses are available without restrictions. This regulatory certainty protects investment value.

Neighborhood Overlay Zone:Includes residential areas like Summit Cove and Dillon Valley where STRs are capped at 35 bookings per year. These caps encourage longer, higher-quality stays rather than nightly turnover.

Basin Caps in Neighborhood Overlay Zone

The Neighborhood Overlay Zone is divided into four basins, each with license caps:

Lower Blue Basin: Cap of 550 licenses (508 Type II licenses as of January 2026)

Upper Blue Basin: Cap of 590 licenses (607 issued)

Snake River Basin: Cap of 130 licenses (158 issued)

Ten Mile Basin: Cap of 20 licenses (24 issued)

Several basins are over their caps because licenses were grandfathered before caps took effect. New applications face waitlists in capped basins.

Some Breckenridge properties are exempt from caps, including timeshare properties and specific condo buildings like Beaver Run, Crystal Peak, Grand Colorado, and others.

Blue River:Currently has no STR license cap, creating flexibility for owners near Breckenridge who want rental income.

Frisco:No cap on the number of nights allowed to rent per year. Occupancy limited to two persons per bedroom plus four additional persons for non-studio units. Frisco has reached its overall license cap and operates a waitlist.

Dillon:Currently no cap on STR licenses being issued.

Silverthorne:Has STR regulations but fewer restrictions than some neighboring towns.

License Requirements and Fees

All owners must apply for a short-term rental license and pay a fee of $250 by June 1st each year. All licenses expire on May 31st annually.

Required for Application:

  • Valid sales tax license

  • Property jurisdiction verification

  • Correct bedroom count (verified with County Assessor)

  • OWTS pumper report if on septic (within 3 years)

  • Well permit if on well water

  • Designated Responsible Agent

All STR properties on well water must submit a well permit at renewal. If the STR has a hot tub, the well permit must show proper augmentation to continue using the hot tub.

Occupancy Limits

Occupancy is limited to two persons per bedroom plus four additional persons for non-studio units. Studio units have a maximum occupancy of four persons.

  • Colorado sales tax
